{"id":10579,"date":"2026-05-06T15:23:31","date_gmt":"2026-05-06T13:23:31","guid":{"rendered":"https:\/\/asdt.eu\/?page_id=10579"},"modified":"2026-06-18T15:51:06","modified_gmt":"2026-06-18T13:51:06","slug":"warranty-and-limitations","status":"publish","type":"page","link":"https:\/\/asdt.eu\/en\/garantias-y-limitaciones\/","title":{"rendered":"Warranties and limitations"},"content":{"rendered":"<div class=\"wp-block-uagb-container uagb-block-bbc785c8 alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-advanced-heading uagb-block-de6971d8\"><h1 class=\"uagb-heading-text\">Responsibility, warranties and limitations<br>of drone detection and mitigation systems<\/h1><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-830d9ae4 alignfull uagb-is-root-container\"><div class=\"uagb-container-inner-blocks-wrap\">\n<p class=\"wp-block-paragraph\">This document is intended as the manufacturer's limited warranty conditions for professional drone and other unmanned aerial systems detection, identification, tracking, command and control, and, where legally and contractually permitted, drone and other unmanned aerial systems jamming, neutralisation or mitigation systems supplied by ASDT Corporation S.L.U. (\u201cASDT\u201d).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unless otherwise expressly agreed in writing, this document does not supersede the particular conditions of the contract signed with the client, but rather complements them. In the event of a contradiction between the main contract and this document, the main contract shall prevail only in respect of that which has been expressly negotiated and accepted in writing by ASDT.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-1c2cbc1a\"><h2 class=\"uagb-heading-text\"><strong>1. Professional nature of the system and exclusion from consumer use.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">1.1. ASDT systems are professional, specialised, and highly complex technological solutions, intended exclusively for business clients, institutions, critical operators, public authorities, security forces and bodies, defence organisations, critical infrastructure managers, airport operators, industrial operators, technology integrators, and other professional users.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.2. ASDT systems are not consumer products, are not designed for purchase or use by consumers or unprofessional end-users, and must not be marketed, resold, assigned, installed, or made available to individuals acting for a purpose unrelated to their commercial, business, trade, or professional activity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.3. Consequently, unless mandatory rules provide otherwise, the guarantee granted by ASDT is configured as a limited contractual guarantee between businesses, professionals or public entities, and not as a legal consumer guarantee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.4. The customer declares that they acquire, install and use the system as part of a professional, business, institutional, administrative, police, military, security, or critical infrastructure protection activity, and that they possess, or must possess before its commissioning, the necessary technical, human, organisational, and legal resources for its safe and lawful use.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-5b1cd3a0\"><h2 class=\"uagb-heading-text\"><strong>2.- System Overview and ASDT's Function as Manufacturer and Integrator.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">2.1. ASDT designs, develops, manufactures, integrates, configures, and supplies professional systems for the detection, identification, analysis, tracking, alerting, command and control, and, where applicable, the jamming, neutralisation, or mitigation of drones and other unmanned aerial systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2. Each system may be composed, according to the contracted configuration, of hardware, software, firmware, sensors, antennae, receivers, radio modules, cameras, radars, electro-optical systems, servers, control stations, user interfaces, communication equipment, power units, batteries, accessories, OEM components, and associated licences and services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.3. ASDT acts as the manufacturer and integrator of the complete system, in so far as it selects, validates, integrates and configures the various components into its own functional architecture. Certain components may be OEM, COTS, firmware or third-party software components, manufactured, licensed or maintained by specialised suppliers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.4. ASDT's responsibility extends to the correct functional integration of the system according to the configuration contracted and validated by ASDT, but does not make ASDT the individual manufacturer of each OEM, COTS, software, firmware, library, network, infrastructure, sensor, link, or subsystem supplied by third parties, except to the extent that is legally unavoidable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.5. The technical characteristics, tolerances, usage conditions, lifecycles, limitations, updates, dependencies, compatibilities and restrictions of OEM or third-party components are part of the inherent limitations of the system and must be observed by the customer.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-f4c91bd9\"><h2 class=\"uagb-heading-text\"><strong>3.- Regulatory framework and administrative authorisations.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">3.1. The customer acknowledges that drone detection, communication, radio analysis, and inhibition or mitigation systems may be subject, depending on the country, type of customer, location, intended use, and technical configuration, to administrative, aeronautical, radio frequency, public safety, defence, telecommunications, data protection, cybersecurity, export control, public procurement, critical infrastructure, and any other applicable sectoral regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.2. In particular, the customer shall be responsible for obtaining, maintaining and complying with, prior to installing, activating or using the system, all licences, permits, authorisations, approvals, coordinations, notifications, spectrum reservations, regulatory approvals or administrative titles that are enforceable in the territory of use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.3. Unless ASDT has expressly assumed a specific regulatory assistance obligation in writing, ASDT does not guarantee that the customer is enabled to use all the functionalities of the system in any jurisdiction, location or operational scenario, nor that it can activate capabilities for inhibition, interference, neutralisation, take-over, signal jamming, geolocation, signal interception, processing or analysis without prior administrative authorisation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.4. The customer must not activate or permit the activation of functionalities requiring authorisation if they do not possess all necessary permissions. The delivery, installation, technical configuration, or functional availability of a module does not, in itself, imply legal authorisation for its use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.5. The customer shall indemnify ASDT against any penalty, claim, damage, cost or liability arising from the use of the system without the required authorisations, breach of regulatory restrictions, use in unauthorised territories, or activation of functionalities not permitted by the applicable regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.6. In the sphere of the European Union and Spain, the client must take into account, where applicable, inter alia, the regulations on radio equipment, electromagnetic compatibility, CE marking, product safety, data protection, cybersecurity, unmanned civil aviation, public procurement, critical infrastructures, private security, public security, and the use of the radio spectrum.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-8c5b733d\"><h2 class=\"uagb-heading-text\"><strong>4. Normal operating conditions.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">4.1. The ASDT warranty will only apply when the system operates under normal operating conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.2. The system shall be deemed to be operating under normal operating conditions when all of the following circumstances are met cumulatively:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(a) that the system has been installed, configured, calibrated, validated and commissioned by ASDT or by personnel expressly authorised by ASDT;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(b) that the system is used in accordance with the contract, accepted offer, technical scope document, official documentation, manuals, data sheets, operating procedures, and ASDT instructions;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(c) that the system operates within the technical, environmental, electrical, radio frequency, temperature, humidity, vibration, power supply, connectivity, storage, interoperability, and workload limits for which it was designed and supplied;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(d) that it be operated by personnel who are duly trained, qualified, and authorised by the client;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">that the preventive maintenance, corrective maintenance, critical updates, inspections, calibrations, and periodic tests indicated by ASDT have been carried out;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(f) that it has not been manipulated, modified, repaired, reconfigured, moved, extended, opened, integrated or connected to third-party systems without prior written authorisation from ASDT;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(g) that the client has kept the necessary records, logs, technical evidence, configurations, and traceability to diagnose any incident;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(h) that the client complies with applicable regulations and has the necessary authorisations for the installation, activation and use of the system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.3. Any use, installation, operation, configuration, integration or maintenance outside of the above conditions will constitute non-compliant use and may result in the total or partial loss of the warranty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.4. Carrying out maintenance in accordance with ASDT specifications, schedules and procedures constitutes an essential condition for the validity and effectiveness of the warranty.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-7538ddca\"><h2 class=\"uagb-heading-text\"><strong>5. Radioelectric environment, dynamic threats and absence of guarantee of outcome.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">5.1. The client acknowledges that drone detection, identification, tracking, classification, and inhibition or mitigation systems operate in open, dynamic, and not fully controllable physical and radio environments by ASDT.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.2. The effective performance of the system may be affected, among other factors, by:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(a) intentional or unintentional interference;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(b) saturation, congestion or noise of the radio spectrum;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(c) meteorological, orographical, urban, maritime, industrial or electromagnetic conditions;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(d) physical obstacles, radio shadows, metallic structures or shielding;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(e) firmware changes, protocols, frequencies, links, navigation systems, autonomy, onboard intelligence or evasive techniques used by drones or third parties;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(f) the use of autonomous, pre-programmed drones, with encrypted communications, with unconventional links, with inertial navigation, with redundant communications or with no detectable emissions;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(g) presence of other security, communications, radar, electronic warfare, telecommunications, cybersecurity or traffic control systems;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(h) regulatory changes or administrative restrictions that limit the use of certain functionalities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.3. ASDT does not guarantee, either expressly or implicitly, that the system will detect, identify, classify, track, locate, alert to, inhibit, neutralise, mitigate or prevent one hundred percent of possible threats, incursions, drones, unmanned aircraft, signals, emissions, trajectories, events or scenarios.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ASDT may recommend, based on risk analysis, the installation's location, the criticality of the protected asset, the radio frequency environment, the threat profile, and the client's operational objectives, the deployment of various systems, sensors, technologies, locations, or complementary protection layers. The purpose of said recommendation is to enhance resilience, redundancy, and risk management capability, but it does not constitute a guarantee of total coverage, universal detection, effective neutralisation of all threats, or complete elimination of risk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.4. The system should be understood as a professional technological tool for supporting risk detection, analysis, management, reduction, and mitigation, and not as an absolute guarantee of security, invulnerability, operational continuity, total coverage of the protected area, absence of intrusions, absence of false alarms, absence of undetected events, effective neutralisation of specific threats, or complete elimination of operational risk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.5. The customer acknowledges that the operational outcome of the system depends on technical, human, environmental, radioelectric, regulatory, tactical, logistical, and third-party factors that may be beyond ASDT's reasonable control, including, but not limited to, site configuration, topography, physical obstacles, radioelectric shadows, interference, spectrum saturation, drone technological advancements, evasive techniques, use of encrypted or unconventional communications, autonomous or pre-programmed drones, availability of administrative authorisations, operator performance, customer protocols, integration with third-party systems, and operational decisions made by the customer or competent authorities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.6. Unless ASDT has expressly accepted in writing specific acceptance metrics, test scenarios, verifiable parameters, controlled test conditions, and concrete contractual consequences, any commercial, technical, demonstrative, pre-contractual or advertising information relating to ranges, coverages, response times, detection rates, false alarm rates, accuracy, geolocation, identification, inhibition, neutralization, mitigation or performance shall be interpreted as a technical estimate conditional on the scenario, and not as a guarantee of result.\n\n5.7. The system does not replace the client's obligations to adopt organisational, human, physical, regulatory, security, cybersecurity, continuity, emergency, surveillance, reaction and coordination measures with competent authorities. ASDT shall not be liable for the absence, insufficiency, inadequacy or defective execution of said protocols, except for breaches directly attributable to ASDT.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-72580a96\"><h2 class=\"uagb-heading-text\"><strong>6.- Manufacturer's Limited Warranty.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">6.1. ASDT guarantees that the supplied system will be free from material defects in manufacturing, assembly, and integration attributable directly to ASDT for a period of <strong>twelve (12) months<\/strong> from the date of delivery, acceptance, making available or commissioning, as determined in the applicable contract. In the absence of contractual provision, the period shall be calculated from the date of delivery of the system to the customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This warranty is granted exclusively within the framework of B2B\/B2S relationships with professional, commercial, institutional, or public clients, and does not constitute a statutory consumer warranty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.2. The warranty exclusively covers defects that:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(a) existing at the time of delivery or resulting from faulty manufacturing, assembly or integration directly attributable to ASDT;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(b) become apparent within the applicable warranty period;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(c) shall be communicated to ASDT in;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(d) are reproducible, verifiable or technically diagnosable by ASDT; and<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(e) do not arise from a cause excluded under this document or the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.3. When ASDT reasonably determines that a defect is covered by this warranty, the customer's sole right shall be for ASDT, at its technical discretion, to repair, replace, reconfigure, upgrade, recalibrate, or correct the defective component, module, software, firmware, subsystem, or element.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ASDT may use new, repaired, reconditioned, or functionally equivalent components, provided they substantially restore the functionality covered by the warranty. The replacement of a component will not necessarily imply the complete replacement of the system, nor will it entitle the user to demand technology, version, manufacturer, model, or component identical to that originally supplied, as long as the alternative is functionally equivalent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The warranty shall not entitle the customer, unless expressly agreed in writing or required by applicable mandatory legislation, to the complete replacement of the system, a full or partial refund of the price, termination of the contract, compensation for damages, penalties, compensation for downtime, temporary replacement equipment, automatic extension of the warranty, or reimbursement of the customer\u2019s internal or external costs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The repair, replacement, reconfiguration, upgrade, recalibration or correction performed by ASDT shall be the customer's sole remedy and ASDT's sole obligation for warranty defects, without prejudice to liabilities that cannot be excluded or limited under applicable law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.4. The repair or replacement of components carried out under warranty shall not restart or extend the warranty period of the complete system. Repaired or replaced components shall be covered for the remaining period of the original system warranty or, if longer, for a period of ninety (90) days from the repair or replacement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.5. Spare parts, modules or components purchased separately outside the scope of the warranty shall be covered by a limited warranty of twelve (12) months from the date of delivery, except for batteries, consumables or items subject to wear and tear, for which the warranty shall be six (6) months and shall be limited to manufacturing defects. OEM or third-party components may be subject to the warranty conditions of their respective manufacturers, without prejudice to the limited warranty expressly provided by ASDT in each case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.6. Unless expressly agreed in writing, the warranty does not cover the costs of dismantling, reinstallation, travel, transport, insurance, customs duties, subsistence allowances, work at height, auxiliary equipment, access permits, service interruptions, operational windows, security escorts, the customer\u2019s own staff, third-party certifications or costs of integration with infrastructure not belonging to ASDT.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-6d99454f\"><h2 class=\"uagb-heading-text\"><strong>7. Consumables, batteries, accessories, software and third-party components.<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">7.1. Batteries, portable power supplies, consumables, parts subject to wear and tear, connectors, cables, brackets, fans, filters, cases, mechanical parts, accessories and other components subject to natural deterioration due to use, charging, discharging, storage, temperature, humidity, life cycles or environmental conditions shall be covered by a limited warranty of six (6) months from the date of delivery, unless the contract or applicable mandatory legislation stipulates a different period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.2. The warranty on batteries and consumables is limited to manufacturing or assembly defects attributable to ASDT, and expressly excludes normal loss of capacity, range, performance, efficiency, charge cycles, chemical degradation, mechanical wear, or deterioration inherent in ordinary use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.3. Software, firmware, licences, APIs, libraries, databases, models, algorithms, third-party modules, operating systems, drivers, monitoring tools, cloud services, connectivity, updates and other digital elements shall be governed by their respective licence, support, maintenance and update terms and conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.4. Unless expressly agreed in writing, ASDT does not guarantee the indefinite availability of software, firmware, licences, cloud services, connectivity, updates, compatibility, APIs or third-party integrations, nor shall it be liable for any changes, discontinuations, vulnerabilities, restrictions, obsolescence, incompatibilities or faults introduced by external providers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.5. ASDT may replace components or modules with functionally equivalent alternatives where the original component has been discontinued, is unsafe, has become obsolete, is not commercially available or cannot be maintained in a satisfactory condition.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-b647385b\"><h2 class=\"uagb-heading-text\"><strong>8. Warranty Exclusions<\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">8.1. The warranty shall be excluded in whole or in part where the fault, defect, damage, deterioration, unavailability or functional deviation arises, directly or indirectly, from any of the following circumstances:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(a) use of the system for purposes other than those agreed or documented;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(b) installation, commissioning, calibration, reconfiguration, repair, relocation, dismantling, opening, tampering with or maintenance by personnel not authorised by ASDT;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(c) integration with third-party networks, platforms, sensors, systems, control centres, software, hardware, vehicles, infrastructure, communications, power sources or equipment not validated by ASDT;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(d) replacement of components with others not supplied, approved or certified by ASDT;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(e) failure to comply with maintenance plans, critical updates, inspections, calibrations, periodic tests, safety instructions or operating procedures;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(f) accidents, negligence, misuse, human error, vandalism, sabotage, cyber-attacks, unauthorised access, malware, loss of credentials, alteration of settings, tampering with logs or exploitation of vulnerabilities not attributable to ASDT;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(g) transport, packaging, storage, preservation or handling not managed by ASDT or carried out under unsuitable conditions;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(h) exposure to environmental, electrical, mechanical, thermal, electromagnetic, radio-electric, chemical, marine, corrosive, or vibration conditions outside of specification;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(i) outages, surges, sags, power deficits, inadequate grounding, air conditioning failures, insufficient connectivity, or unavailability of third-party services;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(j) failure to comply with administrative authorisations, regulatory restrictions, applicable regulations or legally binding instructions for use;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(k) regulatory, technological, operational or threat environment modifications occurring after supply;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ordinary wear and tear, obsolescence, expected degradation or end of useful life of components;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(m) force majeure, unforeseeable circumstances, acts of public authority, war, terrorism, civil unrest, emergencies, natural disasters, fires, floods, lightning strikes, extreme weather conditions or events beyond ASDT\u2019s reasonable control.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8.2. In the above cases, ASDT may, at the customer\u2019s request, offer diagnostic, repair, replacement, upgrade, reinstallation, recalibration or adaptation services outside the warranty period, subject to a quotation and prior acceptance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8.3. Failure to carry out maintenance in accordance with ASDT\u2019s specifications, schedules and procedures, as well as the performance of maintenance by unauthorised personnel, may result in the total or partial exclusion of the warranty in respect of any defect, incident, deterioration, failure, unavailability or functional deviation arising directly or indirectly from such failure to carry out maintenance, which has been exacerbated by it or the diagnosis of which is prevented or hindered by the absence of records, evidence or traceability.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-83f16360\"><h2 class=\"uagb-heading-text\"><strong><strong>9. Limitation of liability<\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">9.1. To the fullest extent permitted by applicable law, ASDT\u2019s total, aggregate and maximum liability to the client, whatever the basis\u2014whether contractual, non-contractual, statutory, pre-contractual, arising from warranty, indemnity, breach, negligence or any other cause\u2014shall be limited to the amount actually paid by the customer to ASDT for the specific system giving rise to the claim, excluding taxes, expenses, ancillary services, maintenance, integrations, developments, consumables, third-party licences, transport, training, support, upgrades, penalties or amounts relating to other systems or contracts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9.2. If the main contract sets out a specific quantitative limit, the limit resulting from that contract shall prevail, provided that it has been expressly accepted by ASDT in writing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9.3. To the fullest extent permitted by applicable law, ASDT shall not be liable for indirect, consequential, incidental, special or punitive damages, exemplary or consequential damages, including, without limitation, loss of profits, loss of revenue, loss of business, loss of production, business interruption, loss of contracts, loss of opportunities, loss of anticipated savings, loss or corruption of data, reputational damage, replacement costs, alternative deployment costs, administrative sanctions, contractual penalties, claims from end customers, third-party claims, damages arising from civil or military security incidents, damages arising from drone intrusions, damage to infrastructure, loss of cargo, loss of operational continuity or costs arising from emergency protocols.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9.4. ASDT accepts no liability for the actions of drones, drone operators, hostile third parties, authorities, system integrators, distributors, communications providers, cloud providers, energy suppliers, infrastructure operators, client personnel or any third party beyond ASDT\u2019s control.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9.5. The above exclusions and limitations shall not apply to the extent that mandatory law prohibits the exclusion or limitation of liability, including, where applicable, liability for wilful misconduct, personal injury caused by gross negligence, or any other liability that cannot be limited under the law.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-ee9a6102\"><h2 class=\"uagb-heading-text\"><strong><strong><strong>10. Product liability, safety and the duty to cooperate<\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">10.1. ASDT supplies its systems in accordance with the state of the art, the applicable specifications and the safety requirements corresponding to the configuration agreed upon at the time of delivery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10.2. The customer must use the system securely, retain the technical documentation, provide adequate training to operating staff, prevent unauthorised access, maintain secure configurations, apply critical updates where reasonably required, and notify ASDT of any incident, fault, vulnerability, security event or anomalous use of which it becomes aware.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10.3. The customer shall cooperate in good faith with ASDT in technical investigations, corrective actions, safety campaigns, recalls, upgrades, regulatory notifications, or mitigation measures that are reasonably necessary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10.4. The customer's failure to fulfil their obligations regarding secure use, maintenance, cooperation, evidence preservation, early notification, or implementation of corrective measures may exclude or reduce ASDT's liability to the extent that such failure has contributed to the damage, worsened its consequences, or prevented its diagnosis.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-f9359461\"><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong>11.- B2B Channel: distributors, integrators and corporate clients<\/strong><\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">11.1. In B2B operations, the client, distributor, or integrator acts as an independent businessman or professional, on their own behalf and for their own account, unless there is a specific written mandate from ASDT.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11.2. No distributor, agent, integrator, reseller, installer, consultant or third party is authorised to assume warranties, commitments, representations, penalties, service levels, operational results, indemnities, warranty extensions, regulatory obligations or liabilities on behalf of ASDT without prior, express, written authorisation from ASDT.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11.3. The distributor or integrator shall be liable to its end client for its own commercial statements, proposals, configurations, integrations, commitments, service levels, adaptations, architectural designs, installations, maintenance, certifications, additional warranties, or services not expressly approved by ASDT.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11.4. When the system is resold, integrated or installed by a third party, ASDT's warranty shall be conditional upon such third party having strictly followed ASDT's technical documentation and holding the authorisation, training, and certification that ASDT requires for the corresponding activity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11.5. The distributor or integrator shall keep ASDT indemnified against claims arising from: (i) unauthorised commitments made by the distributor or integrator; (ii) unvalidated modifications, integrations, or installations; (iii) regulatory non-compliance by the distributor, integrator, or end customer; (iv) use of the system outside of specification; or (v) incomplete, incorrect, or misleading information passed on to the end customer.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-4109ecad\"><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong>12.- B2S Channel: administrations, defence, public security and critical infrastructures<\/strong><\/strong><\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">12.1. In operations with public administrations, defence bodies, public security, security forces, airport authorities, critical operators, critical infrastructure or entities subject to public procurement, the scope of the guarantee shall be interpreted in conjunction with the tender documents, contract, order, award, technical annexes, service levels and applicable acceptance documentation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.2. Unless expressly accepted in writing by ASDT, the tender documents, specifications, demonstrations, pilot tests, validation scenarios or pre-contractual documents shall not constitute a guarantee of operational results outside the specific conditions under which they were tested or accepted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.3. Administrative penalties, contractual penalties, service level agreements, availability commitments, continuity obligations, technological sovereignty requirements, reinforced confidentiality, information classification, national security, export controls, cybersecurity requirements or support obligations shall only be enforceable against ASDT when they are expressly incorporated into the contract and have been accepted by ASDT.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.4. The public or institutional client shall be responsible for operational decisions, use authorisations, coordination with competent authorities, rules of engagement, activation protocols, proportionality of measures, evidence custody, compliance with sector-specific regulations, and the use of the system by authorised personnel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.5. ASDT shall not be liable for any operational, tactical, police, military, airport, administrative or security decisions made by the customer, competent authorities or third parties, even if such decisions are based on information generated by ASDT systems.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-145dacd2\"><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong>13.- Warranty Claim Procedure.<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">13.1. Any warranty claim must be communicated in writing to ASDT via support@asdt.eu within the applicable warranty period and as soon as the customer becomes aware of the issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13.2. The communication must include, at least:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(a) identification of the customer, contract, order, serial number, configuration and system location;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(b) detailed description of the incident, date and time of detection, operating conditions and failure mode;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(c) logs, records, captures, configurations, software\/firmware versions, error messages, technical evidence and any other information reasonably requested by ASDT;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(d) identification of relevant modifications, maintenance, updates, integrations or events that occurred prior to the incident;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">confirmation that the system has been used in accordance with normal operating conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13.3. ASDT may perform remote diagnostics. If remote diagnostics are insufficient, ASDT may request physical access to the system, on-site intervention, shipment of components to ASDT facilities or an authorised centre, or technical collaboration from the client.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13.4. The client shall not manipulate, repair, replace, reconfigure, delete logs, reinstall software, modify evidence or alter the affected system without ASDT's authorisation, unless essential for safety, operational continuity or compliance with an order from a competent authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13.5. Once the incident has been analysed, ASDT will reasonably determine whether it is covered by warranty. If it is covered, ASDT shall apply the remedy it considers technically appropriate in accordance with this document. If it is not covered, ASDT may offer a quote for out-of-warranty intervention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13.6. When the incident is not covered by warranty, or cannot be diagnosed due to lack of information, tampering, system unavailability, or absence of customer cooperation, ASDT may charge for diagnostic, travel, transport, labour, and material costs in accordance with its current tariffs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13.7. Once ASDT has received a complete warranty claim, with the technical information reasonably necessary for its analysis, ASDT shall acknowledge receipt of the claim within a reasonable period and shall endeavour to perform a preliminary remote diagnosis within an estimated timeframe of five (5) to ten (10) business days, unless the technical complexity of the incident, the criticality of the system, lack of information, unavailability of access, need for on-site intervention, involvement of third parties, availability of spare parts, logistical, customs, regulatory or security restrictions, or any circumstance beyond ASDT's reasonable control justifies a longer period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the incident is covered by the warranty, ASDT shall carry out the corresponding repair, replacement, reconfiguration, upgrade, recalibration or correction within a reasonable timeframe, taking into account the nature of the incident, the availability of components or spare parts, the need for technical testing, the system's location, access permits, the customer's operating hours, the intervention of OEM or third-party providers, and any other applicable technical, logistical, regulatory, or security circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The timelines set out in this clause are estimates and do not constitute a service level agreement, commitment to availability, maximum repair time guarantee, or performance obligation, unless ASDT has expressly agreed to them in writing in a separate support, maintenance, or SLA contract.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-751f9a0e\"><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong><strong>14.- Updates, cybersecurity and end-of-life.<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">14.1. ASDT may publish or recommend updates to software, firmware, configuration, security, compatibility or performance. The customer shall apply critical updates that ASDT reasonably identifies as necessary for the security, stability, regulatory compliance or proper functioning of the system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">14.2. ASDT shall not be liable for incidents, vulnerabilities, incompatibilities, failures or damages arising from the client's refusal, delay or inability to install critical updates, unless such inability is directly attributable to ASDT.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">14.3. Certain components, licences, services or modules may reach their end-of-life, end-of-support, commercial discontinuation or technical incompatibility. ASDT will inform the customer, when reasonably possible, of replacement, migration, update or extended maintenance alternatives, which may be subject to separate contracting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">14.4. Unless expressly agreed otherwise, the warranty does not include evolutionary maintenance, adaptation to new threats, new bands, new protocols, new drone architectures, new regulatory requirements, or new integrations that did not exist or were not contracted for at the time of supply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">14.5. ASDT may recommend to the customer the installation of software, firmware, configuration, security, compatibility, performance, algorithm, database, library, signature, technical parameter or integration updates, in order to maintain, optimise or reasonably extend the technical and operational lifespan of the system, improve its resilience, correct vulnerabilities, adapt certain functionalities to technological or regulatory changes, or preserve its compatibility with associated components, sensors, networks, platforms or infrastructures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The client acknowledges that the periodic installation of updates recommended by ASDT is a relevant measure for the preservation, security, stability, effectiveness, and lifespan of the system. Failure to install critical or reasonably necessary updates may affect the system's performance, compatibility, security, maintenance, support, and warranty coverage, as set out in this document or the applicable contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The recommendation, supply or installation of updates will not constitute, unless expressly agreed in writing, a guarantee of indefinite extension of the system's useful life, permanent adaptation to any new threat, drone, protocol, frequency, evasive technique, regulation or operating environment, nor indefinite availability of components, licences, software, firmware, third-party services or future compatibilities.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-e57fd5ad\"><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong><strong>15. Intellectual property, trade secrets, restrictions on use and reverse engineering<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.1. Ownership of ASDT. <\/strong>The sale, supply, assignment, installation, commissioning, maintenance, update, or delivery of the system does not transfer to the customer, distributor, integrator, end-user, or any third party any right of intellectual property, industrial property, trade secret, know-how, technological ownership, or exploitation right over the system, its components, software, firmware, technical documentation, designs, architecture, algorithms, models, databases, interfaces, APIs, configurations, calibrations, methodologies, plans, schematics, parameters, libraries, detection rules, signatures, integrations, developments, tools, manuals, procedures, diagnostic interfaces, command and control systems, source code, object code, manufacturing documentation, maintenance documentation, test information, technical reports, or any other technical or intangible element of ASDT or its licensors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.2. Limited usage licence. <\/strong>The customer receives only a limited, non-exclusive, non-sublicensable, non-transferable, and revocable right, in the event of breach, to use the system in accordance with the contract, technical documentation, applicable licences, and for the professional or institutional purpose for which it was supplied. Any use not expressly authorised is prohibited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.3. Prohibition of copying, disassembly and reverse engineering. <\/strong>The client shall not, nor permit third parties to, directly or indirectly, copy, reproduce, duplicate, translate, adapt, modify, alter, transform, decompile, disassemble, reverse engineer, take apart, open, internally inspect, analyse for the purpose of replication, extract code, extract models, extract algorithms, extract rules, extract parameters, capture operating logic, circumvent security measures, neutralize protection mechanisms, remove seals, tamper with security tags, access undocumented interfaces, replicate architecture, clone configurations, create derivative products, develop competing products, manufacture equivalent components or permit access to the system for any of said purposes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.4. Protection of architecture, configuration and know-how. <\/strong>The following are to be specially protected as confidential information, know-how and, where applicable, trade secrets of ASDT: system architecture, selection and combination of components, integration logic, sensor configuration, antenna layout, calibration parameters, detection rules, classification criteria, mitigation methodologies, algorithms, models, databases, libraries, firmware, diagnostic tools, scripts, technical documentation, internal manuals, test protocols, performance information, coverage maps, radio frequency analysis, vulnerability reports, update procedures, credentials, keys, certificates, tokens, activation mechanisms, anti-tampering measures, and any non-public technical information relating to the design, operation, optimisation, maintenance, or evolution of the system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.5. Third-party access restrictions. <\/strong>The client shall not permit access to the system, nor its documentation, configuration, software, firmware, interfaces, logs, diagnostic tools, or internal components, to ASDT competitors, laboratories, consultants, integrators, manufacturers, technology providers, universities, research centres, non-competent authorities, subcontractors, or third parties, except where such access is strictly necessary for the ordinary operation of the system and has been previously authorised by ASDT in writing or is imposed by a competent authority or applicable mandatory rule.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.6. Prohibition of unauthorised competitive analysis and benchmarking. <\/strong>It is prohibited to use the system, its results, documentation, interfaces, configurations, logs, technical data, or performance information for comparative testing, benchmarking, competitive analysis, public reports, publications, unauthorised certifications, commercial validations, model training, development of competing products or services, or any activity intended to reproduce, substitute, publicly compare, or commercially exploit ASDT's technology, without prior express written authorisation from ASDT.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.7. Safety measures, seals and traceability. <\/strong>ASDT may incorporate technical, physical, logical or contractual protection measures into the system, including seals, tamper-evident mechanisms, encryption, access control, authentication, licenses, activations, usage records, logs, technical telemetry, blocking of unauthorised interfaces, certificate management, watermarks, component serialisation or traceability mechanisms. The customer shall not remove, alter, circumvent, disable, tamper with or interfere with such measures. The alteration, removal or tampering with these measures will constitute a material breach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.8. Technical documentation and enhanced confidentiality. <\/strong>All technical documentation, manuals, plans, diagrams, reports, configurations, integration matrices, maintenance information, credentials, procedures, training, technical presentations or information supplied by ASDT shall be considered confidential, unless ASDT expressly states otherwise in writing. The client must protect such information with a degree of diligence no less than that which it employs to protect its own confidential information of a critical nature and, in any event, with reasonable and appropriate measures given its sensitivity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.9. Custody Obligation and Limitation of Internal Access. <\/strong>The customer shall restrict access to the ASDT system and technical information exclusively to personnel who require such access for the authorised installation, operation, maintenance or supervision of the system. The customer shall be liable for any unauthorised acts, omissions, access, copying, disclosure, manipulation or use by their personnel, directors, employees, collaborators, consultants, subcontractors, integrators, users, operators or any third parties to whom they have granted access.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.10. OEM components and third-party technology. <\/strong>The restrictions set out in this clause shall apply equally to OEM components, COTS, software, firmware, licences, libraries, modules, APIs, tools, documentation, designs, know-how or technology of third parties integrated into the system. The customer shall also comply with the licence, confidentiality, use, export, support and intellectual property conditions of such third parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.11. Mandatory legal exceptions. <\/strong>The foregoing restrictions shall apply to the maximum extent permitted by applicable law and shall not prevent those acts that cannot be prohibited under mandatory rules, including, where applicable, acts strictly necessary permitted by applicable software interoperability regulations, provided that all legal requirements are met, that the necessary information has not been reasonably made available to the customer by ASDT, and that such acts are not used to develop, produce or market substantially similar or competing products or services, nor to infringe the rights of ASDT or its licensors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.12. Notification of access or incidents. <\/strong>The client shall immediately notify ASDT of any unauthorised access, attempted reverse engineering, tampering, opening, loss of control, copying, disclosure, leak, cyber incident, third-party demand, authority demand, breach of security measures, or reasonable suspicion of compromise affecting the system, its documentation, software, firmware, configurations or confidential information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.13. Effects on warranty, support and licences. <\/strong>Any breach of this clause may result, without prejudice to ASDT's other rights, in the total or partial loss of warranty, suspension of support, revocation of licenses, disabling of functionalities, denial of updates, refusal to provide maintenance, demand for the return or destruction of confidential information, and billing for the technical work required to verify, restore, audit, reconfigure or secure the system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.14. Liability and Indemnity. <\/strong>The customer shall be responsible for and indemnify ASDT against any damage, loss, costs, penalties, claims, liabilities, investigation expenses, defence costs, professional fees, loss of technological value, loss of competitive advantage, disclosure of trade secrets, infringement of industrial or intellectual property rights, breach of third-party licences, or third-party claims arising from the customer's breach of this clause, its personnel, users, operators, distributors, integrators, subcontractors, or any third party to whom it has allowed access.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.15. Precautionary measures and specific protection. <\/strong>The client acknowledges that a breach of this clause may cause ASDT irreparable or economically unquantifiable damage. Consequently, ASDT may request, in addition to appropriate compensation, injunctive relief, immediate cessation, withdrawal of derived products, retrieval of information, prohibition of use, audit, deposit, certified destruction, blocking of access, and any other specific protective measures available under applicable law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>15.16. Subsistence. <\/strong>The obligations set out in this clause shall survive the termination, rescission, expiry, return, replacement, repurchase, uninstallation or end-of-life of the system, so long as the protected information is not lawfully public and, in any event, for the maximum period permitted by applicable law relating to trade secrets, confidential information, intellectual property, industrial property and the technology of ASDT or its licensors.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-fbe34d02\"><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong><strong><strong>16.- Export, sanctions and end-use.<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">16.1. The customer shall not export, re-export, transfer, assign, sell, supply, install, activate or use the system, its components, software, documentation or technology in breach of any applicable export control regulations, international sanctions, embargoes, dual-use regulations, defence, public security or end-use restrictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">16.2. The customer declares that they will not use the system for unlawful, unauthorised, or purposes contrary to fundamental rights, international law, or permissions from competent authorities, or purposes prohibited by the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">16.3. ASDT may suspend deliveries, support, updates, warranties or services when it reasonably considers that their provision could infringe sanctions, export, national security, defence, dual-use or any other mandatory applicable regulations.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-dc5509e1\"><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong><strong><strong><strong>17.- Data Protection and Technical Evidence.<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">17.1. When the system processes personal data, images, identifiers, metadata, logs, signals, evidence or operational information that may be personal or sensitive in nature, the client shall be responsible for determining its legal basis, purpose, proportionality, retention, data subject information, impact assessment, security measures and other obligations corresponding to it as the data controller, unless the contract expressly establishes another role.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.2. ASDT shall only process personal data on behalf of the client when there is a processing instruction or other valid legal instrument that permits it and defines the instructions, security measures, sub-processors, transfers, retention, and return or destruction of data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.3. The warranty does not cover damage, penalties or claims arising from the use of the system contrary to data protection regulations, video surveillance, private security, public security, communications secrecy, fundamental rights or applicable sector-specific regulations, unless they are a direct and immediate consequence of a breach attributable to ASDT.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-8e7feedc\"><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong>18. Prevalence, unauthorised modification, and guarantees.<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">18.1. This warranty constitutes the manufacturer's limited warranty granted by ASDT with respect to the system, without prejudice to any additional warranties, service levels, or responsibilities that ASDT may have expressly accepted in a specific agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">18.2. No verbal statement, commercial presentation, demonstration, pilot test, brochure, web information, estimate, proposal, email or informal communication shall modify this warranty unless it is set out in a written document signed or expressly accepted by ASDT with specific reference to the modification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">18.3. ASDT may update this document for future sales, supplies, or contracts. Updates shall not retroactively affect systems already supplied, unless agreed in writing or when required by regulatory or safety demands.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-ceeb964b\"><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong>19. Governing Law and Jurisdiction.<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">19.1. Unless the main contract states otherwise, this document shall be governed and interpreted in accordance with the common Spanish law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">19.2. Unless an overriding jurisdiction applies or arbitration or another jurisdiction is agreed in the main contract, the parties expressly submit to the Courts and Tribunals of the city of Madrid, waiving any other jurisdiction that may be applicable to them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">19.3. In international operations, ASDT may require that the main contract establish specific rules regarding applicable law, jurisdiction, arbitration, prevailing language, export controls, sanctions, taxes, customs duties, local support, after-sales service, data protection, intellectual property, and cross-border enforcement.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-137e712b\"><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong>20. Acceptance.<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">The acquisition, receipt, installation, activation, commissioning, use, or maintenance of the system implies acceptance of this limited warranty, notwithstanding any specific conditions expressly agreed in writing
